Terms of Use

1. Scope These Terms of Use govern the use of the Listening Spaces platform by registered and non-registered users. 2. Platform services Listening Spaces provides an online platform on which users may create, upload, store, publish, and share content with others. There is no entitlement to specific functions or uninterrupted availability at all times. 3. Registration Certain functions may require registration. Users are required to provide accurate information during registration and to keep their access credentials confidential. 4. Responsibility for content Users are solely responsible for the content they post, upload, store, or otherwise make available. Users represent that: - they hold the necessary rights to the content they submit, - the content does not infringe any third-party rights, - the content does not violate applicable law or these Terms of Use. 5. Prohibited content In particular, users must not post, upload, or distribute content that: - violates applicable law, - is insulting, threatening, harassing, or discriminatory, - infringes third-party rights, in particular copyright, trademark, personality, or data protection rights, - is misleading, fraudulent, or deceptive, - contains malware, harmful code, or other security-threatening components, - violates youth protection laws, - constitutes spam or serves the abusive use of the platform. 6. Rights of use To the extent necessary for operation of the platform, the user grants the operator a simple, non-exclusive right, limited to providing the platform, to store, technically process, display, and make the uploaded content publicly available. Such rights are granted only to the extent necessary to provide the platform service. 7. Moderation and measures We are entitled to review content and, where there are indications of violations of these Terms of Use or applicable law, to take appropriate measures. Such measures may include in particular: - non-publication of content - removal of content - technical restriction of visibility - temporary restriction of certain functions - warning - temporary suspension of the user account - permanent suspension of the user account Where legally required or otherwise appropriate, we will inform the affected person of the reasons for such a measure. 8. Reporting content Users and third parties may report content they consider unlawful or in breach of these Terms of Use. Reports should, where possible, include: - a precise identification of the relevant content - a comprehensible explanation of the report - supporting evidence where available - contact details for follow-up questions 9. Availability We strive to ensure that the platform is available as continuously as possible. Maintenance work, security measures, technical disruptions, or circumstances beyond our control may limit availability. 10. Liability We are liable without limitation in cases of intent and gross negligence and in accordance with mandatory statutory provisions. In the event of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded to the extent permitted by law. The above limitations of liability do not apply in cases of injury to life, body, or health. 11. Indemnification To the extent permitted by law, the user shall indemnify us against third-party claims arising from unlawful or non-contractual use of the platform or from content submitted by the user. This also includes reasonable legal defense costs. 12. Termination and ending of use Users may terminate or delete their user account at any time in accordance with the functions provided. We may suspend or terminate user accounts for good cause, in particular in the event of material or repeated breaches of these Terms of Use or applicable law. 13. Changes to the Terms of Use We reserve the right to amend these Terms of Use with effect for the future where there is an objective reason to do so, in particular in the event of changes in the law, platform functions, or for security reasons. 14. Applicable law The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory statutory provisions provide otherwise. 15. Consumer dispute resolution We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
